No prosecution of Border agent for shooting Mexican teenager

A U.S. border patrol agent and his family were relieved on Friday when they were informed that the agent will be prosecuted for shooting and killing a Mexican teenager on the banks of the Rio Grande on June 7, 2010, according to a press statement from the U.S. Attorney General’s office. Justice Department officials said in a news release that its “comprehensive and thorough investigation” determined there was “insufficient evidence to pursue federal criminal charges.” The Justice Department also concluded that no federal civil rights charges could be pursued in this matter.  Under the applicable civil rights statutes, prosecutors must establish, beyond a reasonable doubt, that a law enforcement officer willfully deprived an individual of a constitutional right, meaning with the deliberate and specific intent to do something the law forbids.  This is the highest standard of intent imposed by law. According to law enforcement reports, fifteen-year ancient Sergio Hernandez-Guereca was shot in his head as U.S. Customs and Border Protection agents tried to detain two men who had crossed into the United States illegally near the Paso del Norte Bridge in El Paso, Texas. The teenager was pronounced dead at the scene. A federal law enforcement officer told the Law Enforcement Examiner that Hernandez was with a gang of youths throwing rocks at the agents. The anonymous law enforcement source stated that witnesses claimed one agent fired several shots toward the group, but the still unidentified agent claimed he acted in self-defense. Mexican officials, including President Felipe Calderón, denounced the teen’s death. The country’s secretary of state said the use of firearms was a “disproportionate use of force” in response to rock throwing. But, police use of force experts have told the Law Enforcement Examiner that the throwing of rocks by a suspect is considered use of deadly physical force according to the “Resistance/Force Continuum.” “There appeared to be no doubt that the border officer was being attacked using rocks. All you need is a direct hit on the skull by a rock to cause permanent brain injury or even death,” said Lieutenant Richard Fierra, a charter member of the Society of Police Black Belts and an expert in use-of-force training. The Justice Department claims it conducted a comprehensive and thorough investigation into the shooting, which occurred while smugglers attempting an illegal border crossing hurled rocks from close range at a CBP agent who was attempting to detain a suspect. During the investigation, law enforcement officers and forensic technicians collected, analyzed and reviewed evidence from the scene of the shooting as well as civilian and surveillance video. They also analyzed law enforcement radio traffic, 911 recordings, volumes of CBP agent training and use of force materials.  In addition, investigators reviewed the shooting agent’s training, disciplinary records, and personal history.  Also, they conducted site visits and analysis and consulted with the International Boundary and Water Commission concerning jurisdictional issues. “The investigation revealed that the agent — whose identity has been well-protected – did not act inconsistently with CBP policy or training regarding use of force.  Based on a careful review and analysis of all the evidence, the team concluded that evidence would not be sufficient to prove beyond a reasonable doubt that the CBP agent violated the federal homicide laws in the shooting of Hernandez-Guereca,” according to Justice Department officials. “Accordingly, the investigation into this incident has been closed without prosecution.” No prosecution of Border agent for shooting Mexican teenager by Jim Kouri, CPP syndicated from The Land of the Free .

Obama’s Divisive and Partisan Bin Laden Ad

This ad was coming.  I thought it would have emerged later, but then again Obama’s got nothing else to truly run on:  Obama ordered the operation which took out Osama Bin Laden, but would Romney have done so?  Here’s the ad: I have many issues with this ad: Choosing Bill Clinton narrate a Bin Laden-related ad is poor — were it not for Clinton’s dumbassery, Bin Laden would have been sitting in Gitmo since 1996! Tough choice, huh?  I once questioned my 9-year-ancient niece, “If you knew where a very terrible man was hiding and by trying to get him you might upset someone else, would you still try to get the terrible man?”  She said yes.  Bold, courageous girl or perhaps it wasn’t truly a tough choice to order such an operation?  I’m glad Obama did it, but let’s cut-out the toughness behind such a no-brainer. Without using the tools, tactics, and funding which Obama voted against as senator, the raid would not even have been possible. On Romney likely not making the call:  unnecessarily partisan and divisive attack. By the way, thank you SEAL Team 6. The Obama team defends the ad ;  the Romney camp denounces it as divisive . I’m critical of the ad, not because Obama ordered the hit on Osama, but because he used it to pound his opponent.  Getting Bin Laden was not a partisan act.  If the ad were filled with American flags, grungy special ops soldiers, patriotic music and a narrator speaking about bravery and American strength with a picture of Obama towards the end looking stern and poised, then this ad would have been magnificent.  Scary magnificent.  Alas, Obama is who he is.  Partisan and divisive.

Family Values

Have you ever had a tempting offer that seemed too excellent to be right? One example that comes to mind would be the work at home ads that promise you will make $10,000 the first month and as much as you want after that. The ancient saying “If it sounds too excellent to be right, it probably is” is an axiom of truth. After hearing one of these ads on radio, I reflected back on an offer from a few years back that could have been a lucrative deal, if only those pesky Christian values had not gotten in the way. The casting producer for a show on ABC contacted me about being on their program. She said it was a hit show on ABC’s Disney family hour. Since I do not watch much TV, and never watch regular network programming, I had never heard of the show. The casting producer was looking for an illusionist and his family, and came across my web site (I still perform several ministry illusion shows each year). The filming would have taken a couple of weeks of my life, and though I have no experience as a film actor, I have 17 years’ experience in live entertainment, have dabbled as a contributor in screen writing and at one time produced and directed a weekly radio program. The appearance on this program would have paid $20,000.00. I admit, this amount caused me to raise an eyebrow, but if my family and I had appeared on the program, it would have been the end of my ministry. The potential to corrupt my children was assured because of the nature and content of the show. Though I had never watched the program, the show’s name was enough to turn me off. I declined and soon found out how corrupt it was. To this day, I still have not watched an episode of the show and do not plot on it. The offer came soon after asking God for some extra income for a specific need. AND it was on ABC’s DISNEY FAMILY hour. I had been told by the casting director it was a family show. Surely, this was God answering prayer. But, I learned long ago that the world doesn’t have a clue, when it comes to real family values. I rented a cartoon film from a video store when my daughter was young, and questioned the clerk about the film. She assured me it was a clean, child friendly, wonderful animation. Five minutes into the film, curse words started. I turned it off, took the film back, and with charity, told the employee the film was not a children’s film. Just because a show is centered on a family or families, does not mean it is fit for family consumption. After checking into the situation, it appeared they wanted a Christian family, but I suspected it was for the opportunity to mock Christianity and challenge real family values. Even though I was encouraged by some to consider it, it was never a possibility from the beginning. The importance of a stable, Godly family cannot be overstated. No single institution has been attacked as vehemently and viciously as the family has been attacked. The emasculation of the male, blurring of the roles of the sexes, and laxation of the discipline of children, have all weakened the family in the last 50 years. Family values start with placing value on God as the foundation of the family, led by the Father and supported by the Mother. Discipline and standards motivated by like, will establish the children in habits, manners and a Christian world view philosophy that glorifies God, strengthens churches and produces excellent citizens. Parents have only one shot with their children. That’s why it’s so vital to guard them from that which would steal their innocence and purity and establish and enforce real family values.
