Just in time to take the V.A. scandal out of the headlines while head-faking the nation so a deal can be reached with the Hamas-led terrorist Palestinian government , President Obama neatly handed over five Taliban members who were resting comfortably at Gitmo for one American POW… without notifying Congress, which is illegal since these guys were at Gitmo.

Heck, even Diane Feinstein has to admit the Obama Administration is acting poorly on this one! Some are even openly throwing the I-word (impeachment) around over this — especially since it seems like the American POW, Bowe Bergdahl, allegedly voluntarily walked into Taliban custody .

Constitutional expert John Turley even referred to Obama’s executive malfeasance in this way: “Barack Obama is really the president Richard Nixon always wanted to be.”  Turley is even an ideological sympathizer with Obama on most issues! But, will this amount to anything?

The five Taliban leaders have been released and I’m sure are doing just fine before they rejoin the jihad against America.  If the Obama Nation’s purpose dealt with a V.A. distraction or a pro-Hamas head-fake, it’s worked.  The impeachment talk is hyperbole because, frankly, the GOP have no balls and Obama doesn’t take them seriously anyway.

The left-wing critics will fall into line in time.  It’s a sad state of affairs when we negotiate from a position of weakness with the Taliban and make aid deals with terrorist-sponsors like Hamas without any real consequences on the horizon.

3e434ed5d5e test.jpg 150x105 Democrats Get Their Way At Any CostThere is an apocryphal story from a conversation once had between George Washington and Thomas Jefferson in which GW referred to the Senate as a body whose purpose was to cool House legislation as a saucer is used to cool tea.  The Senate was a slow, deliberative body to counteract the tempestuous House.

From 1789 to 1917 the 2/3 filibuster rule to end debate was in effect.  Over the years the threshold was lowered to 60 votes. However, during the recent Bush years the idea of a “ nuclear option ” was given significant traction since Senate Democrats filibustered significant numbers of Bush judicial nominees.

Then-Senator Obama was quite clear how he felt about the “nuclear option” and how it would further poison our politics.  In the end, though, the Republican-controlled Senate backed away from edge. Earlier today Harry Reid’s Democrat-controlled Senate, facing a similar issue, decided to push the red button:  Reid called for a vote to change the rule on filibustering judicial and executive nominees.

After a brief parliamentary hiccup, a brave new world in the Senate was set into motion — Obama and Reid got their 52-48 simple majority vote to end a 224-year parliamentary tradition.

Three Democrats voted against the measure, standing firm with 2005 Obama. The GOP should be outraged beyond some obligatory and obvious boilerplate responses.  Rather than tsk-tsk , they should threaten similar action once the GOP gets the Senate, which could happen in 11 months.

The Democrats want to destroy the GOP all while the GOP believes it’s the same old game.  The Stupid Party indeed. However, the Dems aren’t thinking about the next election — they’re thinking about the party, throwing radical judges on every bench they can, and leaving a legacy which will far outlast the next Congress.

Hence, Obama’s elation.  His administration may be fatally damaged politically, but the regulatory state, the slow institutionalization of Obamacare, and all of these new judges will make Congress more and more obsolete.  Either way Obama-Reid wins while the people and the Senate as an institution lose.

Impeachment: All you need to know (and you do need to know it).

1. It is NOT necessary that the President, other officers in the executive branch, or federal judges commit a crime before they may be impeached & removed from office. Federalist Paper No. 66 (2nd para) & Federalist  No. 77 (last para) show that the President may be impeached & removed for encroachments, i.e., usurpations of power. Federal judges may also be impeached & removed for usurpations of power ( Federalist No. 81 , 8th para). Throughout The Federalist Papers, it is stated that impeachment is for “political offenses”. 2. The House has the SOLE power of impeachment (Art. I, Sec. 2, last clause).  The Senate has the SOLE power to try all impeachments (Art. I, Sec. 3, next to last clause).  The decision to convict is not reviewable by any other body – and common sense tells us what that means!  The House may impeach, and the Senate may convict, for any reason whatsoever; and their decision cannot be overturned. 3. The meaning of “Treason, Bribery, or other high Crimes and Misdemeanors” at Art. II, Sec. 4, is far broader than one might at first glance think.  Somewhere I saw a scholarly paper showing that the “high” refers to the status of the official – it does not refer to the severity of the offense. Now, note well! “Misdemeanor” has a broader meaning than “a lesser category of criminal offense”.  Webster’s 1828 Dictionary shows the primary meaning is :  “ Ill behavior; evil conduct; fault; mismanagement .” This shows that a President, Vice-president, and all civil Officers and Judges of the United States may be impeached, tried, convicted, and removed from office for “mismanagement”. 4. Errant members of Congress are never impeached – they are expelled (Art. I, Sec. 5, cl. 2). 5. Military personnel are never impeached – they are court-martialed (see UCMJ – Uniform Code of Military Justice), and may be kicked out of the military. 6. It is not feasible to criminally prosecute, under federal law, a sitting President: his prosecutors, the Attorney General and the U.S. Attorneys, all serve at the President’s pleasure.  He can fire anyone who dares to criminally prosecute him.  That is why sitting Presidents who have committed federal crimes must first be removed from office via impeachment, then be criminally prosecuted.  ( Federalist No. 69 , 4 th para). But do not forget : A President may – and should – be impeached & removed for usurpations of power, mismanagement, incompetence, or for any other reason deemed sufficient by Congress . The lawful methods of getting rid of a sitting President [whether eligible or not to hold the office], in addition to impeachment, are set forth in the 25 th Amendment: Natural death, resignation, or inability to do the job. The 22 nd Amendment permits Congress to make laws providing for succession where a President elect has not qualified. Do not spin your wheels in fruitless insistence that a person (who may still be an Indonesian national) who occupies the office of President can’t be impeached because he is ineligible to hold that office.  The FACT is that he holds the office .  Impeachment is a lawful & constitutional method to rid ourselves of this blight. Justice Kennedy’s “demeaning” DOMA ruling

By Dr. T. David Gordon In the limits of this brief essay I cannot adequately address the Defense of Marriage Act (DOMA), or the entirety of the Supreme Court’s recent decision regarding the same. As a native Virginian, however, I must fully disclose that, insofar as the ruling was an effort to preserve the rights of individual states to regulate marriage as they wish, I would have sympathy with the reasoning, and would be willing to hear it out on that narrow ground. But there are several sections of Justice Anthony Kennedy’s reasoning that I regard as unusually problematic, and that is the highly subjective language he employs in the majority opinion. For starters, Kennedy stated: “The principal purpose [of DOMA] is to impose inequality, not for other reasons like governmental efficiency…. By this dynamic DOMA undermines both the public and private significance of state-sanctioned same-sex marriages; for it tells those couples, and all the world, that their otherwise valid marriages are unworthy of federal recognition. This places same-sex couples in an unstable position of being in a second-tier marriage. The differentiation demeans the couple, whose moral and sexual choices the Constitution protects … and whose relationship the State has sought to dignify. And it humiliates tens of thousands of children now being raised by same-sex couples. The law in question makes it even more difficult for the children to understand the integrity and closeness of their own family and its concord with other families in their community and in their daily lives.” I see at least four problems with this particular Kennedy statement: First, by a biological/reproductive understanding of marriage, such unions are in fact in the “second-tier;” they are “bottom-tier.”

By: Dan Weber BOHEMIA, NY, July 5 — You are more likely to read or hear about the granny who fought off an attacker than about the more than 6 million seniors who are victims of elder abuse each year, according to Dan Weber, president of the Association of Mature American Citizens. “In fact,” Weber said, “the national media virtually ignored Elder Abuse Awareness Day in June, an event designed to bring attention to what is considered the nation’s dirty little secret that has serious psychological and physical implications for America’s senior citizens.” The actor, Mickey Rooney, made headlines when he testified in Congress in 2011 about the abuse he suffered at the hands of his stepson and his stepson’s wife who allegedly denied him food and medicine and robbed him of millions of dollars over a period of several years. In testimony before the Senate Aging Committee Rooney said: “Over the course of time, my daily life became unbearable. I felt trapped, scared, used and frustrated. But above all, I felt helpless. For years I suffered silently, unable to muster the courage to seek the help I knew I needed.” The Pew Research Center has reported that ten thousand Americans will turn 65 years of age each day for the next two decades and the Bureau of Justice Statistics has reported that at least 10% of them will be victims of elder abuse. “These are pretty startling statistics,” Weber commented, noting that “these crimes against the elderly take the form of neglect, physical abuse, financial exploitation, sexual abuse, in that order. Yet, for whatever reason, people do not want to talk about them. But we must bring this disgraceful crime wave out into the open if we, as a nation, hope to stem the tide.” The experts say that most of older Americans who are victims of abuse live alone and require the help of care givers, but many like Mickey Rooney live with family. “It’s up to each and every one of us to get involved. There are many Web sites, such as the National Council on Aging [www.ncoa.org] that offer advice on how friends, neighbors and relatives can read the signs of elder abuse by taking the time to talk and listen to the stories suspected targets have to tell, and then to have the courage to intervene,” Weber explained.
